Website Hosting & Maintenance - Terms of Service

OVERVIEW

This website hosting and maintenance service is operated by Truth & Co. Throughout the agreement, the terms “we,” “us,” and “our” refer to Truth & Co. By engaging in our website hosting and maintenance services, you agree to be bound by the following terms and conditions. Please read these Terms of Service carefully before accessing or using our services.

SECTION 1 - CONTRACT DETAILS

1.1. Contract Length
Clients can choose between a monthly or yearly (12-month) term.

1.2. Billing Method
Prepaid billing; clients will be billed monthly or yearly in advance. Payment can be made by card or Bacs Direct Debit.

1.3. Cancellations
Cancellations are processed at the end of the billing period. Full refund if canceled within 14 days of the first payment.

SECTION 2 - SERVICE FEATURES

2.1. Fully Managed VPS Hosting
Our fully managed VPS hosting service includes a dedicated virtual server, ensuring optimal performance, security, and customization based on your website's requirements.

2.2. Daily Backups with Cloud Storage
We perform daily backups of your website data, securely stored in cloud storage for easy retrieval in case of data loss or emergencies.

2.3. Server and Package Updates
Monthly updates to server configurations and software packages ensure your hosting environment is up-to-date and secure.

2.4. CMS and Plugin Updates
Monthly updates to your content management system (CMS) and plugins to enhance functionality and address potential security vulnerabilities.

SECTION 3 - RESPONSIBILITIES

3.1. Service Provider Responsibilities
We are responsible for maintaining the overall functionality, security, and performance of the hosting environment.

3.2. Client Responsibilities
Clients are responsible for providing accurate billing information and promptly responding to any requests for cooperation, such as required updates or information needed for backups.

SECTION 4 - DATA AND BACKUP

4.1. Backup Procedures
Backups are performed daily, including database and website content. Backups are stored securely for a specified duration.

4.2. Data Restoration
In the event of data loss, we will make reasonable efforts to restore data from the most recent backup. Clients are responsible for notifying us promptly to initiate the restoration process.

SECTION 5 - TERMINATION

5.1. Termination Process
Either party may terminate the agreement with a written notice. Termination requests are processed at the end of the billing period.

5.2. Data Retrieval
Clients are responsible for retrieving their data within 30 days of termination. After this period, data may be permanently deleted.

SECTION 6 - JURISDICTION

6.1. Jurisdiction
This agreement is governed by the laws of the United Kingdom. Any disputes are subject to the exclusive jurisdiction of the UK courts.

SECTION 7 - LIMITATION OF LIABILITY

7.1. Limitation of Liability
While we strive for uninterrupted service, we do not guarantee continuous, error-free operation. Our liability is limited to the fees paid for the specific service. We are not liable for any indirect or consequential damages.
